A teoria do comportamento da lei de Donald Black foi formulada em meados do século XX e desenvolvida para a análise da incidência da lei nas sociedades. É um importante método de pesquisa para estudar a vida social,especialmente controle social estatal. E as novas formas de controle social são muito diversificadas nas sociedades do século XXI por causa do pluralismo jurídico. Os operadores do Direito devem compreender como, nos dias de hoje, nas recentes comunidades de pessoas, este processo ocorre e qual o melhor modo de se aplicar lei com justiça. O método de Black identifica a quantidade e a direção da lei no meio ambiente social, o que permite conhecer-se a eficácia das normas jurídicas. E este conhecimento, na atualidade, é realmente necessário para a efetiva integração entre sociedade e norma.

The behavioral theory of Donald Black was formulated in the middle of the XXth century and was created to analyze law incidence in societies. It is an important method of studying social life, especially the state social control. And the new forms of social control are very diverse in the XXI century’s societies due to juridic pluralism. Law operators must understand how this process occurs nowadays in recent communities and identify which is the best way of enforcing law with justice. Black’s method identifies the quantity and the direction social environments assume, what enables us to know the efficacy of legal norms. Nowadays this knowledge is truly necessary to reach an effective integration between society and the norm.
